Your Rights as a Survivor in California
California law gives adult survivors meaningful time and options to seek justice in civil court:
- Longer deadlines. For assaults that happened when you were an adult, California generally allows a civil lawsuit within 10 years of the last act or attempted act, or within 3 years of discovering the resulting injury, whichever is later (Code of Civil Procedure 340.16).
- Revived claims against companies. A new California law (AB 250) opens a window from January 1, 2026 through December 31, 2027 for certain older claims where a company or institution covered up or tried to cover up prior assaults.
- No conviction required. You do not need criminal charges or a conviction to bring a civil claim.
- Privacy protections. Courts can allow survivors to proceed using a pseudonym such as Jane Doe in appropriate cases.
