What to Do After an Uber or Lyft Accident
- Get medical care first. Call 911 if anyone is hurt. Some injuries do not show symptoms for hours or days.
- Call the police. A police report creates an independent record of what happened.
- Screenshot the app. Save your trip details, driver name, vehicle, and receipt before anything changes.
- Report it in the app. Report the crash to Uber or Lyft, but keep it brief and factual.
- Document everything. Photograph the scene, vehicles, road conditions, and your injuries. Get witness names and numbers.
- Be careful with insurers. You do not have to give the other driver’s insurer a recorded statement. Talk to a lawyer first.

Who Pays in a Rideshare Accident?
California law requires Uber and Lyft to carry insurance that changes based on the driver’s app status (Public Utilities Code 5433):
- Passenger on board or ride accepted. At least $1,000,000 in liability coverage, from the moment a driver accepts a ride until the ride is complete.
- App on, waiting for a ride. At least $50,000 per person, $100,000 per accident, and $30,000 property damage, plus $200,000 in excess coverage.
- App off. Only the driver’s personal auto insurance applies.
- Uninsured drivers. If an uninsured or underinsured driver hits your rideshare, the company’s uninsured motorist coverage may apply, though its limits are lower than the $1 million liability policy.

How Much Is My Rideshare Accident Case Worth?
There is no average settlement that applies to every rideshare accident case. In California, the value of a claim depends on:
- Your injuries and future care. The severity of the injury, surgeries, and treatment you will need going forward.
- Lost income. Wages you missed and any reduced ability to work in the future.
- Pain and life impact. How the injury affects your daily life, relationships, and activities.
- Fault. Under California’s comparative fault rule, your recovery is reduced by any share of fault assigned to you.
- Available insurance. The policies that apply often set a practical ceiling on recovery, so we look for every source.
When a passenger was on board or a ride had been accepted, at least $1,000,000 in liability coverage is available, which can matter a great deal for serious injuries.

Uber and Lyft Accident FAQs
Can you sue Uber if you get in a car accident?
You can usually make a claim against Uber’s or Lyft’s insurance policy, and sometimes the driver or other drivers involved. Whether the company itself is liable depends on the facts.
How much money will I get from an Uber accident claim?
It depends on your injuries, medical costs, lost income, and which insurance applies. A $1 million policy is available when a passenger was on board or a ride was accepted.
I was the Uber driver. Can I make a claim?
If another driver caused the crash, you can claim against their insurance. Your rights against the rideshare company depend on your coverage and status.
